SECTION 1 – PRIVACY STATEMENT

This Privacy Policy sets forth the policy of Buy My VA House (together with its subsidiaries, “the Company,” “us,” “we,” or “our”) concerning the collection, handling and storage of user information collected through the use of www.buymyvahouse.com and/or any other related website that links to this Privacy Policy (the “Website”).  Please read this Privacy Policy carefully to understand how we process your information.

By using the Company’s service (“Services”) or accessing the Company’s Website in any manner, Customer acknowledges that Customer accepts the practices and policies outlined in this Privacy Policy, and Customer hereby acknowledges and agrees that we may collect, use, store, and share Customer’s personal information in the following ways.  

SECTION 2 – WHAT INFORMATION IS COLLECTED, HOW IS IT COLLECTED, AND HOW IS IT USED?

The Company may collect and store various types of information about Customers and Customers’ use of the Services via various platforms generally classified as Personal Information and Non-Personal Information.

The Company gathers and uses Personal Information internally in connection with providing the Services to Customers including to personalize, evaluate, and improve the Services and the Company’s ability to provide the Services to Customers, to contact Customer, to respond to and fulfill Customers’ requests and orders regarding the Services, to analyze how Customers uses the Services, and for compliance purposes including but not limited to audits, fraud monitoring and prevention, and any other legal processes deemed necessary and applicable (i) to comply with federal and local laws, (ii)  to protect our rights, privacy, safety, or property and/or that of our affiliates and/or Customers, or (iii) to allow the Company and/or its affiliates to pursue damages or remedies available under federal or local law.

Personal Information

Personal Information is the information Customers provide to us voluntarily or passively through Customers’ use of the Services and/or Website and which is directly associated with or reasonably linked to a specific person, computer, or device.  This information may be provided by Customers when purchasing products or services, creating an account, subscribing to newsletters or catalogs, or contacting the Company with an inquiry or request.  We collect and store Personal Information such as Customers’ name, email address, phone number, address, and billing information (such as credit card account number or other financial account information) for the purpose of providing services and products to Customers, processing payment information, providing invoices and/or order confirmations, and to communicate with Customers.  

The Company will communicate with Customers if Customers have provided us with the means to do so.  For example, if a Customer has given the Company Customer’s email address or phone number, we will email or call the Customer about the Customer’s use of the Services and other transactional information related to the Customer.

The Company reserves the right to combine Customers’ Personal Information collected from the Website with additional Personal Information obtained from our social network platforms or any other platform.

Some forms of Non-Personal Information as described below will be classified as Personal Information if required by applicable law or when such information is directly associated with or reasonably linked to a specific person, computer or device, or is combined with other forms of Personal Information.

The Personal Information Customers send and receive is transmitted over a wireless network and may be subject to interception by unauthorized third parties who seek to do Customers harm.  While it is the Company’s objective to take reasonable measures to reduce the risk that unauthorized third parties will be able to intercept Customers’ Personal Information sent and received through the Website or in connection with the Company’s services, the Company cannot, and does not, make any guarantee that transmissions over the internet are 100% secure or error-free.

The Company recommends that Customers use caution when sending any Personal Information over the internet and that Customers use encryption technology whenever possible such as websites that have the “https” designation in the website’s address bar and show a padlock icon in the browser’s window.

Your California Privacy Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask the Company for a notice identifying the categories of Personal Information which the Company shares with its affiliates and/or other third parties for their marketing purposes and providing contact information for such affiliates and/or third parties unless the Company meets certain exceptions in the law.  This Privacy Policy qualifies for the exception to those requirements.  If you reside in California and have an established business relationship with the Company, you may request information about the Company’s opt-out and opt-in policies of sharing Personal Information with other companies (including The Company’ affiliates) for their marketing purposes.  Please send your written request via email or postal mail following the instructions below.  The Company will not accept requests via the telephone or facsimile.  The Company will not respond to requests that are not labeled or sent properly or do not have complete information.

Non-Personal Information

Website Information; Use of Cookies and other Similar Tracking Technology

A cookie is a small data file that’s downloaded to a computer or device when a website is visited. The Company may use different cookies including functional, performance, advertising, and social media, or content cookies. Cookies allow for a better browsing experience by allowing the Website to remember Customers’ actions and preferences (such as login and region selection). This means Customers do not have to re-enter this information each time Customers return to the site or browse from one page to another.

SECTION 3 – WHAT PERSONAL INFORMATION CAN CUSTOMERS ACCESS, MODIFY, AND/OR DELETE?

Generally, Customers may access the following Personal Information in their account:

  • Full name
  • Username and password
  • Email address
  • Telephone number
  • Billing and service address
  • Account and billing information

By contacting the Company at info@buymyvahouse.com or through any online access portal the Company may create to enable Customers to view and modify their account settings.  Customers may access, and, in some cases, edit or delete the Personal Information listed above.  For example, the Company may retain historic email, billing, and/or service addresses for security and verification purposes.  Customers may not delete such information.   

When Customers update Personal Information, the Company may maintain a copy of the unrevised information in our records for internal security reasons and recordkeeping.  Some information may remain in our records after it is modified, amended, or deleted by Customers or by us.  We may use any aggregated data derived from or incorporating Customers’ Personal Information even after Customers update or delete it but not in a manner that would identify those Customers personally.  We may also maintain Personal Information regarding Customers and Customers’ use of the Services after Customers are no longer Customers as required by our business practices, by law, and/or tax reporting purposes.

SECTION 4 – DISCLOSURE AND SALE OF INFORMATION

Personal Information

The Company may disclose and/or sell Customers’ Personal Information as defined by the California Privacy Act of 2018 (“CCPA”).  Information gathered by the Company from third parties and through its own analysis of information provided by Customers to, or accessed by, the Company may be used to generate marketing leads and assess the quality of such leads, which leads may be provided to other Customers in exchange for consideration.  If Customers do not want any information provided to us to be sold or used in the manner described above, Customers shall send a written opt-out request via email to the Company at info@asisbuyscc.com.  The Company will not rent, sell, or disclose Personal Information to anyone not related to it for marketing or promotional purposes unless in connection with a potential or actual sale, merger, or a corporate restructuring by or of the Company. 

Notwithstanding the foregoing, the Company will not knowingly sell any personal information of anyone under the age of 16.

The Company will use Personal Information to send Customers marketing and advertising messages related to our Services and Website.  We may deliver a marketing or advertising message based on Customers’ visits to our Website, which will be general advertising or “Contextual Advertising,” which is advertising based on the subject matter or the content of the specific website page or subject matter. We may also send Customers “First Party Advertising,” which is advertising that is customized or personalized based on a history of Customers’ use of our Services (possibly combined with information from our social network platforms). First Party Advertising is based solely on a combination of information the Company collects from Customers – not from Customers’ visits to other websites across the Internet.

Customers may opt-out of First Party Advertising but not Contextual Advertising.  No Personal Information is used to deliver Contextual Advertising; it will automatically appear based on the content or webpages that are viewed by Customers.  Customers may continue to receive general advertising if Customers opt-out of First Party Advertising, but such advertising will not be customized or personalized.

The Company reserves the right to access, read, preserve, and disclose any Personal Information, Non-Personal Information, or Other Information to which the Company has access if it has a good faith belief that doing so (i) will implement and/or enforce the terms and conditions of this Privacy Policy; (ii) is necessary during the course of any legal process related to the Services; or (iii) is required by federal or state law.

Other Information

The Company may use and disclose Other Information for any lawful purpose such as for research, reporting and analytic purposes, and to improve the Website. The Company may share aggregated and non-identifying information about Customers collected through the registration process as well as through online surveys and promotions with advertisers. In some instances, we use this aggregated and non-identifying information to deliver tailored advertisements or joint ventures. Additionally, our partners may have advertisements or co-branded webpages that are cosponsored by an affiliate, independent contractor seller, or non-affiliated partner. We may share non-identifying and aggregate information with such partners in order to administer the co-branded products or services offered.

If we are required to treat Other Information as Personal Information under applicable law, we may use it for all the purposes for which we use and disclose Personal Information.

In some instances, we may combine Other Information with Personal Information (such as by combining non-identifying information such as a user’s state with the user’s name). If we combine any Other Information and Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.

SECTION 5 – THIRD-PARTY DISCLOSURES AND SERVICES

Customers can always choose not to disclose Personal Information to the Company.  However, certain Personal Information is necessary for us to provide the Services or products to Customers.  Customers may opt out of sharing Personal Information only for marketing or advertising purposes but not for business or operational purposes.

Customers may opt out of email marketing and advertising from the Company using the “Unsubscribe” mechanism in each email.  Before we send Customers a text for any reason, or send Customers a pre-recorded call that contains advertising or marketing information, we will secure Customers’ prior written express consent, which can be given via a voice recording, email, text message, postal mail, or telephone key press.  Non-telemarketing pre-recorded calls do not require Customers’ prior express consent in writing unless they are sent to a wireless device.  Customer understands, acknowledges, and agrees that such texts and pre-recorded telemarketing calls may be sent using an autodialer and are not conditioned on Customer’s purchase of the Services.  Customers may opt out of receiving text messages any time by replying “STOP” or “UNSUBSCRIBE” to the text message.  Customers may opt out of receiving pre-recorded calls by the opt-out instructions in the call.  However, Customers will continue to receive calls related to debt-collection and Customers’ current Service.  

The third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.  However, certain third-party service providers have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.  For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. 

Once you leave our Website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Website’s Terms of Service.  This Privacy Policy does not address, and we are not responsible for, the privacy practices of any third parties or other sites, and we encourage you to read their privacy statements.  The inclusion of a link on the Website does not imply endorsement of the linked site or service by us or our affiliates.  The presence of a link does not constitute or imply the Company’s endorsement, recommendation, or sponsorship of the content, goods, services, business, or privacy practices on such websites or online services. 

SECTION 6 – SECURITY

To protect your Personal Information, the Company has implemented reasonable precautions and follows industry best practices to ensure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.  Customers are also responsible for the security of their Personal Information.  Where Customers have selected a password to access certain parts of our Website, Customers are responsible for keeping this password confidential and limiting access to electronic devices and browser history.  We make no guarantees regarding the security of any Personal Information transmitted to our Website.  Customer acknowledges and agrees to notify us of any unauthorized use of Customer’s username, password, or account.  Customer acknowledges that Customer is solely responsible for any use of our Services via Customer’s username and password.

The Company will not send an email or text communications, nor should Customers respond to any email or text communications, requesting sensitive or confidential Personal Information such as social security number, bank account or credit card account number, or driver’s license number.  If Customers receive an email or text requesting any such information from the Company or someone that claims they are with the Company, please contact the Company immediately at info@buymyvahouse.com

SECTION 7 – AGE OF CONSENT

This Website is not intended for the use of individuals under the age of 18.  By using this site, Customer represents that Customer is at least the age of majority in Customer’s state or province of residence.  The Company does not knowingly collect or maintain personal information from individuals under 18 years of age.
